1. Who you are contracting with
The Artefact service ("Service") is provided by Shane Paola ("we", "us", "Seller"). By accessing or using the Service you agree to these Terms.
2. Acceptance
By creating an account or continuing to use the Service you confirm that you have read, understood, and agreed to these Terms. If you are using the Service on behalf of an organisation, you confirm you have authority to bind that organisation.
3. The Service
Artefact lets you upload single-file HTML artefacts, share them via password-protected links, and collect inline feedback from guests.
4. Acceptable use
You must not misuse the Service. In particular, you must not: (a) use it unlawfully or fraudulently; (b) upload or share content that infringes intellectual property, violates privacy, contains malware, or is otherwise illegal; (c) probe, scan, scrape, or interfere with the Service or its security; (d) use the Service to send spam or harass others.
5. Account & credentials
You are responsible for keeping your account credentials confidential and for activity that occurs under your account. Provide accurate information and keep it up to date.
6. Your content
You retain ownership of artefacts you upload. You grant us a limited licence to host, process, and display your content solely to provide the Service to you and your invited guests.
7. Intellectual property
The Service, including its software, documentation, and branding, is owned by Shane Paola and protected by intellectual property laws. You may not copy, reverse engineer, resell, or redistribute the Service or circumvent its technical limits.
8. Payments & Merchant of Record
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns. Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms and our Refund Policy.
9. Service level
We aim to keep the Service available, but we do not guarantee that it will be uninterrupted, timely, secure, or error-free. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
10. Suspension & termination
We may suspend or terminate your access for: material breach of these Terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the Service at any time. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.
11. Liability
To the fullest extent permitted by law, our aggregate liability under or in connection with these Terms is limited to the fees you paid to us (via Paddle) in the 12 months preceding the event giving rise to the claim. We are not liable for indirect, consequential, or special damages, including loss of profits, data, or goodwill. Nothing in these Terms excludes liability that cannot be excluded by law.
12. Changes
We may update these Terms from time to time. Material changes will be notified through the Service or by email.
13. Governing law
These Terms are governed by the laws of the jurisdiction in which Shane Paola is established, without regard to conflict-of-laws principles.
